N Carolina's Threat To Tesla Likely Unconstitutional

Recently, a California tax break was struck down as a violation of the Dormant Interstate Commerce Clause. The tax break excluded a portion of capital gain realized upon the sale of certain businesses. Among the various requirements to qualify for the tax break, a business needed to have at least 80% of its payroll in California . . . to the detriment of employment in other states. In another recent case, New York attempted to place restrictions on grapes being imported from other states that would not be imposed on grapes grown in New York. These restrictions were struck down.
